At Pitcha, operated by Zella group ("we," "us," or "our"), we value your privacy and are committed to protecting your personal information. This Privacy Policy outlines how we collect, use, disclose, and safeguard your information when you use our Pitcha mobile application (the "Service"). By using Pitcha, you agree to the terms of this Privacy Policy. Please read it carefully.

1. Information We Collect

Profile Data: When you create a Pitcha account, we may collect personal information such as your name, username, email address, phone number, profile picture, and any other information you choose to provide. Your profile data is stored securely. Our developers and support staff do not have access to your personal profile information unless required for specific support requests initiated by you or as outlined in this policy for content review.

User-Generated Content (Posts, Images, Videos, Livestreams): We collect the content you create, share, or upload on Pitcha, including photos, videos, comments, messages, and livestream content ("User Content"). We do not proactively monitor or access your User Content unless it is reported by another user for violating our Terms of Service (e.g., abuse, nudity, CSAE), or if our systems flag it for potential violation of our policies.

Messages: We collect messages you send and receive through the Service. While messages are not end-to-end encrypted by default, we employ robust security protocols to protect message content against unauthorized access or interception during transmission and storage. Messages may be reviewed by our team if reported for violating our Terms of Service or if flagged by our safety systems.

Usage Data: We automatically collect certain information when you use the Service, such as your IP address, device type, operating system, app version, access times, pages viewed, features used, and general interaction patterns. This data is primarily collected in an anonymized or aggregated form to help us understand how our Service is used, to improve functionality, and for security purposes.

Information from Reports: If you or another user reports content or behavior, we will collect the information provided in the report, including the nature of the report and the content in question.

2. How We Use Your Information

3. Data Protection, Security, and Modification

Our Security Measures: We utilize industry-standard security protocols and measures, including secure server environments, data encryption (where appropriate, such as for passwords), and access controls to protect your data. We conduct regular reviews of our security practices to enhance protection.

Data Integrity and Modification: We do not modify your personal data or User Content. Your information remains as you provide it. However, if User Content is found to violate our Terms of Service, Community Guidelines, or Child Safety Standards (e.g., nudity, hate speech, CSAM), we reserve the right to take action on that content as outlined in those policies. This action may include removing the content, restricting its visibility, or suspending/terminating the associated account. Such actions are taken to maintain the safety and integrity of the Pitcha platform and are not considered a modification of your underlying personal data but rather an enforcement of our platform rules.

Your Responsibilities: The security of your account also depends on you. You are responsible for keeping your account password confidential and secure. We strongly advise against sharing your password with anyone. Pitcha will never ask you for your password. If you believe your account has been compromised, please contact us immediately at [email protected]. You should only share content that you are comfortable with and only with individuals you trust. Sharing sensitive information is at your own risk.

No Guarantee: While we strive to use commercially acceptable means to protect your information, no method of transmission over the Internet or method of electronic storage is 100% secure. Therefore, we cannot guarantee its absolute security.

4. Sharing and Disclosure of Information

We do not sell your personal information. We may share your information in the following circumstances:

With Other Users: Your profile information and User Content (posts, public livestreams) will be visible to other users of Pitcha as per your sharing settings and the nature of the platform. Messages are visible to the recipients you send them to.

Service Providers: We may share information with third-party vendors, consultants, and other service providers who need access to such information to carry out work on our behalf (e.g., cloud hosting, data analytics, customer support). These providers are contractually obligated to protect your information and use it only for the purposes for which it was disclosed.

Legal Requirements and Safety: We may disclose your information if we believe disclosure is necessary or appropriate to: (a) comply with applicable laws, regulations, legal processes, or governmental requests; (b) enforce our Terms of Service or other agreements, policies, and standards, including investigation of potential violations thereof; (c) protect the rights, property, or safety of Zella group, our users, children, or the public as required or permitted by law (this includes reporting CSAM to NCMEC or other authorities); (d) detect, prevent, or otherwise address fraud, security, or technical issues.

Business Transfers: In connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company, your information may be transferred as part of that transaction.

With Your Consent: We may share your information for other purposes with your explicit consent.

5. Reporting and Content Review

If you encounter content or behavior that you believe violates our Terms of Service, Community Guidelines, or Child Safety Standards (e.g., abuse, nudity, harassment, CSAE), please use the in-app reporting tools or contact us directly at [email protected]. Reported content or accounts may be accessed and reviewed by our dedicated safety and moderation team to determine appropriate action in line with our policies.

6. Third-Party Services and Advertisements

Pitcha may display advertisements from third parties or include links to third-party websites and services that are not operated by us. If you click on a third-party link or ad, you will be directed to that third party's site or service. We do not control and are not responsible for the content, privacy policies, or practices of any third-party sites or services. We strongly advise you to review the privacy policy of every site you visit.

7. Children's Privacy

Pitcha is not intended for use by individuals under the age of 13. We do not knowingly collect personal information from children under 13. If we become aware that we have collected personal information from a child under 13 without verification of parental consent, we will take steps to remove that information from our servers. 8. Your Choices and Rights

You may have certain rights regarding your personal information, subject to local data protection laws. These may include the right to access, correct, update, or request deletion of your personal information.
